  • 摘要: 我国对于合同法有了进一步的改进和完善,并且对于承揽合同也制定了相关的规章制度,但是就雇佣合同这方面还没有明文专章。一直以来,与不动产有关的雇佣合同一直与承揽合同有着紧密的联系,很难做到明确的区分和辨别。我国的《物权法(草案)》就不动产的范围也没有清晰明确的规定。在日常的工作当中,只有对不动产的承揽和雇佣合同做到有效的明确的辨别,才能更好的保护人们的合法权益。才能更好的构建和谐社会。真正做的社会的公平与正义。
  • In recent years, China's contract law has been further improved and perfected, and relevant rules and regulations have been formulated for the contract of employment, but there is no specific chapter on the employment contract. For a long time, the employment contract related to real estate is closely related to the contract of undertaking, so it is difficult to make a clear distinction. China's property law (Draft) has no clear provisions on the scope of real estate. In daily work, only the real estate contract and employment contract to do effective and clear distinction, in order to better protect people's legitimate rights and interests. In order to better build a harmonious society. What we really want to do is the fairness and justice of the society.
