• 摘要： 鉴于目前我国未成年入犯罪的发展形势，我国刑法对未成年人犯罪采取的刑罚手段存在不足，应当借鉴国外的前科消灭、不定期刑等刑罚种类，重建我国未成年犯罪人刑罚体系，更好地保护未成年人的各项权利，使其受到公正、人道的司法处理。
• In view of the current development trend of juvenile delinquency in China, the criminal law of our country has insufficient penalty means for juvenile delinquency. We should learn from foreign penalty types, such as the elimination of criminal record and irregular penalty, to reconstruct the penalty system of juvenile delinquency in our country, better protect the rights of minors, and make them subject to fair and humane judicial treatment
