• 摘要： 为了更好地学习和贯彻落实债的保全制度，本文就债的保全制度中债权人的代位权制度的立法宗旨、基本性质、特点、构成要件，法律效力，行使的范围以及对完善我国代位权制度的设想等问题谈了一下自己的观点。
• In order to better study and implement the debt preservation system, this paper discusses the legislative purpose, basic nature, characteristics, constituent elements, legal effect, scope of exercise of the creditor's subrogation system in the debt preservation system, as well as the assumption of perfecting the subrogation system in China.
