The laborer’s obligation of explanation is clearly stipulated in the "Labor Contract Law of the People's Republic of China" (hereinafter referred to as the "Labor Contract Law"), which is opposite to the employer's obligation of notification. Economic progress has led to the vigorous development of the labor market. The problem of information asymmetry between employers and workers is widespread, and even deception and concealment of true information may occur. The law stipulates that the purpose of the worker’s obligation to explain is to ensure that the employer and the worker can understand and trust each other in an increasingly complex market environment, so as to successfully complete the employment. However, this regulation has the problem of being too general and unclear. Compared with countries and regions with developed rule of law, my country has not yet formed a complete system in this respect. This article will start from the perspective of laborers, combing out the legal provisions, and standardize and theoretically explain the system of laborer’s accountability, and reflect on the implementation of the system of laborer’s accountability from the perspective of legislation and practice. The suggestions for perfecting this system make this system more compatible with judicial practice.
